President of the Legal Council of the State

Pursuant to Article 11 of Organic Law 4831/2021, the President of the Legal Council of the State is the highest administrative and disciplinary head of both the core legal staff and the administrative staff.

Among other duties, the President:

  • Presides over the Plenary Session and the Chambers of the Legal Council of the State.
  • Orders inspections and approves or endorses acts related to cases involving the State and the Independent Authority for Public Revenue (IAPR / AADE).
  • Grants powers of attorney for the handling of legal cases.
  • Holds the competence to initiate and pursue legal actions representing the State.

The President as Agent before the ECtHR

Furthermore, the President of the Legal Council of the State acts as the Agent of the Hellenic Republic before the European Court of Human Rights (ECtHR), with the following responsibilities:

  • Representing the Hellenic Republic before the Court and providing assistance for the implementation of the European Convention on Human Rights (ECHR) at national level.
  • Cooperating with international and national bodies to ensure the execution of ECtHR judgments.
  • Informing the Greek authorities of the relevant case-law and of their compliance obligations.
  • Participating in working groups and legislative drafting processes related to human rights.
  • Assigning cases to members of the Legal Council of the State and coordinating the relevant mechanism for monitoring compliance with ECtHR judgments.

In support of these competences, since 2023 a special Thematic Formation for cases concerning the European Convention on Human Rights and international courts has been in operation, established by Decision No. 689/2022 of the President of the Legal Council of the State.
