Welcome to the Legal Council of the State

Pursuant to Article 100A of the Constitution, the Legal Council of the State, as a senior body of the Administration, is established as a constitutionally recognized and guaranteed institution.

The Legal Council of the State (L.C.S.) is a single, supreme State Authority and falls directly under the Minister of Finance (Article 3, Law 4831/2021).

Mandate

  • Judicial support and representation before national, EU, and international jurisdictional bodies, as well as before national and international arbitral tribunals, in accordance with the provisions in force.
  • The issuance of legal opinions on inquiries submitted by the Administration.
  • The recognition of claims against the State.
  • The judicial and extrajudicial settlement of disputes involving the State.
  • The issuance of opinions on the submission of State disputes to arbitration, where this is not provided for by special provisions, the drafting and review of arbitration clauses in State contracts, and the appointment of arbitrators on behalf of the State.
  • The provision of legal assistance to the Administration in the drafting and conclusion of contracts.
  • The provision of legislative support to the Administration in the preparation of draft laws or regulatory acts.
  • The submission of recommendations to the competent Ministers for the enactment of provisions necessary to safeguard the public interest.
  • The provision of legal support to the Hellenic Republic before the Committee of Ministers of the Council of Europe and before any other European Union or international body or organization, unless otherwise provided by a special provision.
  • The provision of legal support to the Interministerial Committee for Restructuring and Privatizations, in particular on matters relating to the procedure and terms governing privatizations.
  • The provision of legal support to Independent Authorities and legal entities governed by public law, as provided for in the new Organization of the Legal Council of the State or in special provisions.
